TERMS OF SERVICE
These Terms of Service govern your use of terribleartstudios.com and purchases made from Terrible Art.
By visiting our website, using our services or placing an order, you agree to these Terms of Service and all policies referenced on the website, including our Return and Refund Policy and Shipping Policy.
GENERAL CONDITIONS
You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase.
You may not use our website, artwork, products or services for any unlawful, fraudulent, abusive or unauthorized purpose. You may not interfere with the security, performance or operation of the website.
We reserve the right to refuse service, cancel orders, restrict access or terminate use of the website when reasonably necessary to protect Terrible Art, our customers, our intellectual property or our service providers.
PRODUCT INFORMATION
Terrible Art makes reasonable efforts to display artwork, materials, colors, sizes, frames, pricing and product details accurately.
Digital screens, monitor settings, lighting, print surfaces, canvas texture, paper texture, framing, crop and artwork size may affect how colors and details appear in person.
Product photographs may include staged room mockups intended to demonstrate scale and presentation. Customers are responsible for reviewing the listed dimensions before purchasing.
We may update product descriptions, correct errors, change prices or discontinue products without notice. If a material error affects an existing order, we may contact the customer, offer an appropriate correction or cancel and refund the affected item.
ORDERS AND ORDER ACCEPTANCE
Submitting an order is an offer to purchase. An order confirmation acknowledges that we received the order but does not guarantee final acceptance.
Terrible Art may decline or cancel an order because of:
• Suspected fraud or unauthorized payment
• Incorrect pricing or product information
• Payment-processing problems
• Unavailable materials or production capacity
• Prohibited or infringing custom content
• An inability to fulfill the order
• Other legitimate business or legal reasons
If Terrible Art cancels an order after payment has been collected, the affected amount will be refunded to the original payment method.
PRICING AND PAYMENT
Prices are displayed in the currency shown on the website and may change without notice.
Applicable taxes, international shipping, customs duties and other charges will be displayed or described during checkout when possible.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the payment provider to charge the total shown during checkout.
Discounts and promotional offers are subject to their stated conditions. Promotions cannot be combined unless expressly permitted and may be changed or ended before purchase.
MADE-TO-ORDER PRODUCTS
Terrible Art posters, canvases, framed artwork and custom pieces are made to order. Processing begins the same day an order is submitted.
Because production begins quickly and specifically for each purchase, orders cannot normally be canceled, changed, returned or exchanged.
All purchases are subject to our posted Cancellation, Return and Refund, Shipping, and Order Issue policies.
CUSTOM AND PERSONALIZED CONTENT
When submitting photographs, artwork, logos, names, text, instructions or other materials, you represent that:
• You own the submitted content or have permission to use it
• Producing the requested item will not violate another person’s copyright, trademark, privacy, publicity or other rights
• The submitted content is lawful and does not contain prohibited material
You grant Terrible Art and its production partners a limited, nonexclusive license to store, reproduce, crop, resize, format, modify and transmit submitted content only as reasonably necessary to create the requested product, fulfill the order, provide customer service, resolve claims and comply with legal obligations.
Submitting content does not give Terrible Art permission to use personal photographs or custom artwork publicly for advertising, social media or portfolio purposes unless separate permission is obtained.
We may refuse custom content that is unlawful, threatening, hateful, sexually exploitative, defamatory, infringing or otherwise inappropriate.
Customers are responsible for claims or losses caused by content submitted without sufficient rights or authorization.
PROOF APPROVAL
When a digital proof is offered, the customer is responsible for carefully reviewing all names, spelling, colors, images, positioning and other details.
Approving a proof authorizes Terrible Art to begin production based on the approved version. Terrible Art is not responsible for customer-approved errors.
INTELLECTUAL PROPERTY
The Terrible Art website and its original artwork, designs, Ghost character, logos, branding, graphics, photographs, videos, text, layouts and other content are owned by or licensed to Terrible Art and are protected by intellectual-property laws.
Unless written permission is provided, you may not:
• Copy, reproduce or distribute our artwork or website content
• Sell merchandise containing our artwork or branding
• Modify or create derivative commercial works
• Scrape or systematically collect website content
• Use our content to train artificial-intelligence or machine-learning systems
• Remove copyright, trademark or ownership notices
• Use Terrible Art branding in a way that suggests sponsorship or affiliation
Purchasing a physical product transfers ownership of that physical item only. It does not transfer copyright, trademark rights, reproduction rights, digital rights or commercial-use rights in the artwork.
ACCURACY OF CUSTOMER INFORMATION
Customers agree to provide complete, current and accurate billing, payment, contact and shipping information.
Terrible Art is not responsible for delays, failed delivery or additional costs caused by incorrect or incomplete information submitted by the customer.
REVIEWS AND FEEDBACK
If you voluntarily submit a product review, photograph, testimonial, suggestion or other feedback, you grant Terrible Art a nonexclusive, worldwide, royalty-free license to display, reproduce and use that submission in connection with the brand and its marketing, subject to applicable law.
Do not submit private information or content belonging to another person without permission.
We may moderate or decline content that is unlawful, abusive, fraudulent, irrelevant or inappropriate. We do not guarantee that every submission will be published.
PROHIBITED USES
You may not use the website to:
• Violate any law or regulation
• Infringe intellectual-property or privacy rights
• Transmit malicious code or interfere with website security
• Collect customer or website data without authorization
• Impersonate another person or provide fraudulent information
• Engage in abusive, threatening or discriminatory conduct

SHIPPING, RETURNS AND ORDER ISSUES
Shipping, tracking, cancellations, returns, refunds, damaged orders, incorrect products and package claims are governed by the corresponding policies posted on terribleartstudios.com. Those policies form part of these Terms of Service.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.”
Terrible Art does not guarantee that the website will always be uninterrupted, completely secure or free from errors.
Nothing in these Terms excludes warranties, rights or remedies that cannot legally be waived.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Terrible Art and its owners, personnel and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits or data, arising from use of the website or purchase of products.
Where liability cannot be excluded, Terrible Art’s total liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.
INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Terrible Art harmless from third-party claims, damages and reasonable costs arising from:
• Your unlawful use of the website

• Your violation of another party’s rights

SEVERABILITY
